We wtorek i w środę (15 - 16 października) Sejm dokończył 86. posiedzenie. Posłowie uchwalili 18 ustaw, podjęli cztery uchwały oraz rozpatrzyli senackie poprawki do jednej ustawy. Izba zapoznała się także ze sprawozdaniem komisji śledczej badającej działania organów i instytucji publicznych wobec podmiotów wchodzących w skład grupy Amber Gold. Po zakończeniu środowego bloku głosowań marszałek Sejmu Elżbieta Witek podziękowała posłom za pracę w mijającej kadencji.
Najważniejsze decyzje
W środowym bloku głosowań Sejm wprowadził oczekiwane przez kierowców zmiany do prawa o ruchu drogowym. Dzięki obowiązkowi tworzenia „korytarza życia” służby ratownicze szybciej dotrą na miejsce wypadku, natomiast wymóg „jazdy na suwak” upłynni ruch drogowy.
Odpowiedzą na postulaty przedsiębiorców jest znowelizowane przez Izbę prawo własności przemysłowej. Posłowie doprecyzowali pojęcie wynalazku, wyeliminowali niejasności dotyczące ochrony praw własności przemysłowej oraz zwolnili małych i średnich przedsiębiorców rozpoczynających działalność z opłat okresowych na wzory przemysłowe i znaki towarowe.
Zmniejszenie emisji spalin będzie efektem przyjęcia przez Sejm noweli ustawy o podatku akcyzowym. Nabywcy pojazdów hybrydowych będą płacić o połowę mniejszy podatek przy zakupie pojazdów o napędzie spalinowo-elektrycznym.
Pozostałe przyjęte ustawy
Kary do pięciu lat pozbawienia wolności będą grozić rodzicom, którzy uczestniczyć będą w procedurze nielegalnej adopcji własnych dzieci. Nowelizacja Kodeksu karnego ma ukrócić proceder handlu dziećmi.
Jakość danych zgromadzonych w rejestrach państwowych poprawi się dzięki uchwalonej przez Izbę nowelizacji ustawy o informatyzacji działalności podmiotów realizujących zadania publiczne i niektórych innych ustaw.
Uchwalone przez Izbę zasady kontroli i postępowania z wodami balastowymi i osadami ze statków przyczynią się do zapobiegania zanieczyszczeniom mórz.
Zrównanie minimalnych pensji pracowników naukowych PAN z minimalnymi stawkami pracowników państwowych uczelni wyższych przewiduje nowelizacja ustawy o Polskiej Akademii Nauk. Otrzymają oni także prawo do stosowania 50 proc. kosztów uzyskania przychodów do całości wynagrodzenia.
Lekarze, pielęgniarki, fizjoterapeuci i inne osoby wykonujące zawody medyczne będą mogły przystąpić do szkolenia specjalizacyjnego, np. w dziedzinie psychoterapii dzieci i młodzieży – zakłada uchwalona przez Izbę nowelizacja ustawy o uzyskiwaniu tytułu specjalisty w ochronie zdrowia.
Dzięki nowelizacji ustawy o sporcie łatwiejsze stanie się uzyskanie statusu polskiego związku sportowego. Zmiany są odpowiedzią na postulaty organizacji sportowych i dotyczyć będą takich dyscyplin jak m.in. ju-jitsu, kendo, kick-boxing.
W reakcji na wyrok Trybunału Konstytucyjnego Sejm znowelizował kodeks rodzinny i opiekuńczy. Dzięki zmianom termin wytoczenia powództwa o zaprzeczenie ojcostwa będzie liczony od daty, w której pełnoletnie dziecko dowiedziało się o swoim rzeczywistym pochodzeniu. Dotychczasowe przepisy ograniczały to prawo do trzech lat od osiągnięcia pełnoletności. Wypełnieniem orzeczenia Trybunału jest także uchwalona przez Izbę nowelizacja prawa oświatowego, zawierająca przepisy określające sposób obliczenia kosztów przejazdu dziecka niepełnosprawnego i jego rodzica do szkoły lub przedszkola, które są zwracane rodzicom.
Kilka z przyjętych ustaw miało na celu dostosowanie polskich przepisów do prawa Unii Europejskiej. Chodzi o zmiany w ustawach o przeciwdziałaniu praniu pieniędzy oraz finansowaniu terroryzmu, przepisów dotyczących oferty publicznej w zakresie m.in. zasad emisji papierów wartościowych oraz w ustawie o rozstrzyganiu sporów dotyczących podwójnego opodatkowania.
Sejm zgodził się także na ratyfikację przez Prezydenta kilku umów międzynarodowych: Międzynarodowej konwencji o kontroli i postępowaniu ze statkowymi wodami balastowymi i osadami, Konwencji o ochronie osób w związku z automatycznym przetwarzaniem danych osobowych, Konwencji nr 188 dotyczącej pracy w sektorze rybołówstwa przyjętej prze Międzynarodową Organizację Pracy, a także Porozumienia ustanawiającego Międzynarodowy Fundusz Rozwoju Rolnictwa.
Uchwały Sejmu
Rok 2020 będzie „Rokiem Zaślubin Polski z morzem w Pucku”. 10 lutego przyszłego roku przypada setna rocznicą zaślubin Polski z Bałtykiem dokonanych w Pucku przez gen. Józefa Hallera. Sejm przyjął poselski projekt uchwały w tej sprawie. Posłowie zdecydowali także, że patronką bieżącego roku będzie Barbara Skarga – filozof, profesor PAN. W 2019 r. przypada setna rocznica jej urodzin. Sejm przyjął też uchwałę w sprawie potępienia wszelkich aktów nienawiści i pogardy antykatolickiej.
Pozostałe decyzje Izby
Sejm przyjął także poprawki Senatu do nowelizacji Prawa ochrony środowiska oraz zaakceptował informację o udziale Polski w pracach UE w okresie prezydencji rumuńskiej. Posłowie nie przyjęli wniosku o odrzucenie w pierwszym czytaniu obywatelskiego projektu zmieniającego kodeks karny. Posłowie wysłuchali tez informacji o działalności Sądu Najwyższego w roku 2018 oraz informacja o działalności Izby Dyscyplinarnej Sądu Najwyższego w roku 2018, a także mieli możliwość zadania przedstawicielom rządu pytań w sprawach bieżących. We wtorek ślubowanie poselskie złożyła poseł Edyta Kubik. która w ławach poselskich zastąpiła zmarłego Kornela Morawieckiego
Sprawozdanie komisji śledczej
W środę, w trzecim dniu 86. posiedzenia, Izba wysłuchała sprawozdania z prac Komisji Śledczej do zbadania prawidłowości i legalności działań organów i instytucji publicznych wobec podmiotów wchodzących w skład Grupy Amber Gold. Prace komisji podsumował poseł Jarosław Krajewski. 132 posiedzenia, 141 świadków, 2 konfrontacje, zawiadomienia do prokuratury ws. 29 osób, 15 tys. tomów akt śledztwa – efektem prac posłów był liczący niemal 600 stron raport. Jak podkreślił poseł sprawozdawca, „komisja dokonała szeregu istotnych ustaleń, które pomogły innym organom w prowadzeniu postępowań w sprawie Amber Gold”.

Second day and third day of the 86th sitting of the Sejm. Summary
On Tuesday and Wednesday (15–16 October) the Sejm concluded its 86th sitting. The deputies adopted 18 acts, passed four resolutions and examined the Senate’s amendments to one act. The House also read the report of the investigative committee on the actions of public authorities and institutions in relation to entities belonging to the Amber Gold group. When Wednesday’s voting block was completed, the Marshal of the Sejm Elżbieta Witek thanked the deputies for their work in the passing term of the Sejm.
Most important decisions
In the voting block on Wednesday, the Sejm introduced the amendments to the Road Traffic Law awaited by drivers. The obligation to form an “emergency corridor” will enable emergency services to arrive quicker at accident sites, and the requirement to follow the “zip merge” technique will streamline road traffic.
The House’s amendments to the industrial property law respond to the demands of entrepreneurs. The deputies clarified the notion of invention, eliminated ambiguities regarding protection of industrial property rights and exempted small and medium-sized entrepreneurs starting up businesses from periodic fees for industrial designs and trademarks.
The Sejm’s amendments to the Act on excise duty will result in a reduction of exhaust emission. Buyers of hybrid vehicles will pay a tax amount reduced by one half when purchasing vehicles with diesel-electric drive.
Other adopted acts
Parents who participate in the procedure of illegal adoption of their children will be punishable by up to five years in prison. Amendments to the Penal Code are to curb child trafficking.
The quality of data collected in state registers will improve due to the amendment to the Act on computerisation of the activity of entities performing public tasks and certain other acts, adopted by the House.
The House adopted principles for the control and management of ships’ ballast water and sediments, which will contribute to preventing marine pollution.
The amended Act on the Polish Academy of Sciences provides for equalising the wages of PAS researchers with the minimum wages of state university employees. They will also be eligible for a 50% rate of tax deductible costs to be applied to their entire income.
Physicians, nurses, physiotherapists and other health professionals will be able to enrol in a specialised training, e.g. in psychotherapy for children and adolescents, as provided for in the amendment to the Act on obtaining the title of specialist in healthcare adopted by the House.
Due to the amendment to the Act on sports, it will be easier to acquire the status of a Polish sports association. These changes are in response to appeals of sports organisations and will apply to such disciplines as jujitsu, kendo, kickboxing.
Following the judgement of the Constitutional Tribunal, the Sejm amended the Family and Guardianship Code. The changes provide for the time limit for bringing proceedings for revocation of paternity to be counted from the date on which an adult child finds out about their true origin. The existing provisions limited this right to three years as of reaching the age of majority. Adoption by the House of the amended Education Law, which includes provisions defining the method for calculating the reimbursed cost of commuting to school or preschool by a disabled child and its parent, is also an implementation of the Tribunal’s ruling.
Several of the acts adopted were aimed at aligning Polish provisions to EU law. This is the case for amendments to the Acts on anti-money laundering and combating the financing of terrorism, provisions on public offer with regard to – among others – the rules on the issue of securities and to the Act on double taxation dispute resolution.
The Sejm also approved ratification by the President of several international agreements: the International Convention for the Control and Management of Ships' Ballast Water and Sediments, the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data, Convention no. 188 concerning work in the fishing sector adopted by the International Labour Organization and the Agreement establishing the International Fund for Agricultural Development.
Sejm resolutions
The year 2020 will be “The Year of the Poland's Wedding to the Sea in the city of Puck”. 10 February next year marks the 100th anniversary of Poland's Wedding to the Baltic Sea conducted in Puck by General Józef Haller. The Sejm adopted the deputies’ bill on this subject. The deputies also decided that the patron of this year would be Barbara Skarga – a philosopher, PAS professor. 2019 marks her 100th birthday. The Sejm also adopted a resolution on condemning all hate incidents and anti-Catholic contempt.
Other decisions of the House
Furthermore, the House adopted the Senate’s amendments to the Environmental Protection Law and accepted the information on Poland’s participation in EU work during the Romanian Presidency. The deputies did not adopt the motion to reject the citizens’ draft amendment to the Penal Code in the first reading. They also listened to the information on the Supreme Court’s activities in 2018 and on the activities of the Disciplinary Chamber of the Supreme Court in 2018, and had the opportunity to ask government representatives questions on current issues. On Tuesday, deputy Edyta Kubik, who replaced the late Kornel Morawiecki in the Sejm, took the deputies’ oath.
Report of the investigative committee
On Wednesday, the third day of the 86th sitting, the House heard the report on the works of the Investigative Committee established to investigate the regularity and legality of the actions of public authorities and institutions in relation to entities belonging to the Amber Gold Group. The Committee’s work was summarised by deputy Jarosław Krajewski. 132 hearings, 141 witnesses, 2 confrontations, referrals to the public prosecutor’s office regarding 29 persons, 15,000 volumes of files – the deputies’ work resulted in a report of nearly 600 pages. As emphasised by the rapporteur, “the committee made several meaningful findings that helped other authorities to carry out the proceedings in the Amber Gold case”.
